Overview

These Terms of Service govern your purchase and use of the WCAGpatch WordPress plugin. By purchasing or using WCAGpatch, you agree to these terms. WCAGpatch is a WordPress plugin that scans websites for WCAG 2.1 accessibility violations, applies AI-powered fixes, and generates compliance certificates.

License Terms

WCAGpatch is licensed per tier. Each license grants you a non-exclusive, non-transferable right to install and use the plugin according to your purchased tier:

  • Starter ($69): Licensed for use on 1 (one) WordPress site.
  • Pro ($149): Licensed for use on up to 5 (five) WordPress sites.
  • Agency ($299): Licensed for use on unlimited WordPress sites owned or managed by the license holder.

A "site" is defined as a single WordPress installation on a unique domain or subdomain. Staging and local development environments do not count toward your site limit.

Lifetime Access

"Lifetime access" means you receive access to the plugin and all updates for the lifetime of the product. This means as long as WCAGpatch continues to be developed and maintained. If WCAGpatch is discontinued, you retain the right to use the last released version indefinitely. Lifetime access does not guarantee perpetual development, feature additions, or compatibility with future WordPress releases.

Money-Back Guarantee

WCAGpatch offers a 30-day money-back guarantee. If you are not satisfied with the plugin for any reason, contact us within 30 days of purchase at hello@wcagpatch.com and we will issue a full refund. No questions asked. After 30 days, all sales are final.

Acceptable Use

You may not:

  • Resell, sublicense, or distribute your WCAGpatch license key to third parties.
  • Redistribute, share, or publicly post the plugin files or source code.
  • Use WCAGpatch to provide accessibility scanning or remediation as a paid service to others, unless you hold an Agency license.
  • Attempt to reverse-engineer, decompile, or extract the source code of the plugin beyond what is permitted by applicable law.

Limitation of Liability

WCAGpatch is an automated accessibility scanning and remediation tool. It is not a legal service and does not provide legal advice. WCAGpatch is not responsible for any ADA lawsuits, demand letters, legal actions, fines, penalties, or legal outcomes that may arise in connection with your website, whether or not you use WCAGpatch.

To the maximum extent permitted by applicable law, WCAGpatch and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use or inability to use the plugin.

Our total liability for any claim arising from these terms or your use of WCAGpatch shall not exceed the amount you paid for your license.

No Warranty

WCAGpatch is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the plugin will be error-free, uninterrupted, or that it will detect or fix all accessibility violations on your website.

Third-Party Services

WCAGpatch integrates with the OpenAI API for AI-powered features. Your use of the OpenAI API is governed by OpenAI's own terms of service and usage policies. You are responsible for your own OpenAI API key, usage, and associated costs. WCAGpatch is not affiliated with or endorsed by OpenAI.

Governing Law

These terms are governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict of law principles. Any disputes arising from these terms or your use of WCAGpatch shall be resolved in the courts located in Minnesota, USA.

Changes to These Terms

We may update these terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of WCAGpatch after changes constitutes acceptance of the revised terms.
